These Terms and Conditions (“Terms”) govern your access to and use of the websites, pages, forms, and related online services operated by Hammonds Companies and its affiliated entities (collectively, “Hammonds,” “we,” “us,” or “our”), including www.hammondscos.com (the “Site”).

By accessing or using the Site, submitting a contact or quote request, downloading materials, or otherwise interacting with the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

If you use the Site on behalf of a company or other entity, you represent that you have authority to bind that entity, and “you” includes that entity.

1. Nature of the Site; No Binding Offer

The Site provides general information about Hammonds additive injection systems, parts, accessories, services, distributors, and related offerings. Content on the Site—including specifications, drawings, manuals, images, descriptions, performance claims, application guidance, pricing indications, and availability—is for informational and evaluation purposes only.

Nothing on the Site constitutes a binding offer to sell, a commitment to supply, an engineering certification, or a guarantee of suitability for your specific application. Any quotation, proposal, purchase order acknowledgment, sales contract, warranty certificate, or other commercial document issued by Hammonds controls over Site content in the event of conflict.

2. Eligibility and Intended Audience

The Site is intended for business, industrial, commercial, governmental, and professional users evaluating or purchasing additive injection equipment and related products and services. You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Site or submit information through it.

You are responsible for compliance with all laws applicable to your use of the Site and to any equipment, parts, or information you obtain in connection with Hammonds.

3. Account-Free Access; Accurate Information

Certain Site features may allow you to submit inquiries without creating an account. You agree that all information you provide through the Site—including contact details, company information, application data, and technical requirements—will be true, accurate, current, and complete. You agree not to impersonate any person or entity or misrepresent your affiliation.

4. Quotes, Technical Recommendations, and Communications

Submitting a quote request, contact form, or other inquiry does not create a contract for sale. Quotes, estimates, lead times, recommendations, and technical suggestions provided by Hammonds (whether through the Site, email, phone, or otherwise) are preliminary unless and until confirmed in a writing accepted by Hammonds under its then-current commercial terms.

You acknowledge that fuel treatment, additive injection, aviation and industrial fueling, and related operations involve complex engineering, safety, regulatory, and operational considerations. Hammonds does not provide site-specific engineering, permitting, or legal advice through the Site. You are solely responsible for verifying suitability, compatibility, installation requirements, operating procedures, and compliance with applicable codes, standards, and customer or agency specifications.

5. Product Information; Changes

Hammonds may modify, discontinue, or update products, specifications, features, configurations, documentation, and Site content at any time without notice. Published specifications may differ from delivered equipment based on configuration, options, revisions, local requirements, or custom engineering. Always confirm critical requirements with Hammonds before ordering, installing, or operating equipment.

6. Intellectual Property

The Site and all content on it—including text, graphics, logos, icons, images, photographs, drawings, videos, software, data compilations, trade dress, and the selection and arrangement thereof—are owned by Hammonds or its licensors and are protected by United States and international intellectual property laws.

Hammonds grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your internal business evaluation of Hammonds products and services. You may not copy, modify, distribute, publicly display, reverse engineer, scrape, frame, mirror, or create derivative works from the Site or its content except as expressly permitted in writing by Hammonds or as allowed by mandatory law.

“Hammonds,” related marks, product names, and logos are trademarks or trade names of Hammonds or its affiliates. No license to use any mark is granted except as necessary to refer accurately to Hammonds products in ordinary business communications.

7. Acceptable Use

You agree not to:

  • use the Site in any manner that violates applicable law or regulation;
  • interfere with or disrupt the Site, servers, or networks, including by introducing malware, conducting denial-of-service attacks, or overloading systems;
  • attempt to gain unauthorized access to the Site, related systems, or data;
  • use automated means (including bots, scrapers, or spiders) to access, monitor, or copy the Site without prior written consent, except for generally available public search engine indexing;
  • submit unlawful, fraudulent, defamatory, abusive, or infringing content;
  • use the Site to send spam or unsolicited commercial communications; or
  • misuse security, anti-bot, or verification features (including reCAPTCHA).

Hammonds may suspend or terminate access to the Site, refuse or delete submissions, and take other appropriate action for violations of these Terms or for any conduct that may harm Hammonds, its customers, distributors, or other users.

8. User Submissions

If you submit information, feedback, ideas, application details, or other materials through the Site (“Submissions”), you grant Hammonds a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, process, adapt, and communicate those Submissions as needed to respond to you, operate the Site, improve products and services, and fulfill related business purposes, subject to our Privacy Policy.

You represent that you have all rights necessary to provide Submissions and that they do not infringe or violate any third-party rights. Submissions are not confidential except as required by our Privacy Policy or a separate written confidentiality agreement signed by Hammonds.

9. Third-Party Sites, Distributors, and Services

The Site may link to third-party websites, distributor resources, maps, document hosts, or other services. Hammonds does not control and is not responsible for third-party content, policies, or practices. Links do not imply endorsement. Your use of third-party sites is at your own risk and subject to their terms.

Authorized distributors and service partners are independent businesses. Unless Hammonds expressly agrees in writing, Hammonds is not responsible for distributor acts, omissions, pricing, warranties (except as Hammonds itself provides), or services.

10. Export Controls and Restricted Uses

Hammonds products, technical data, and related information may be subject to U.S. export control and sanctions laws. You agree not to access, use, export, re-export, or transfer Site content or Hammonds products in violation of applicable export, re-export, or sanctions laws, including restrictions involving embargoed countries, restricted parties, or prohibited end uses. You are solely responsible for obtaining any required licenses or approvals.

11. Warranties; Product Warranty Programs

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR QUIET ENJOYMENT.

Hammonds does not warrant that the Site will be uninterrupted, secure, error-free, or free of harmful components, or that content will be complete or current.

Product warranties, if any, are provided solely under Hammonds’ applicable written warranty terms (including any program described on our 3 Year Warranty page or in your sales documents). Website statements do not expand or modify those warranty terms.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL HAMMONDS, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, GOODWILL, OR DATA; BUSINESS INTERRUPTION; OR COST OF SUBSTITUTE GOODS OR SERVICES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR RELIANCE ON SITE CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAMMONDS’ TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations; in those jurisdictions, liability is limited to the fullest extent permitted by law. This section does not limit liability that cannot be limited under applicable law, or liabilities arising under a separate signed sales or warranty agreement for purchased products (which are governed by those agreements).

13. Indemnification

You agree to defend, indemnify, and hold harmless Hammonds and its affiliates, and their respective officers, directors, employees, agents, and distributors, from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your Submissions; (c) your violation of these Terms or applicable law; or (d) your misuse of Hammonds products or information obtained through the Site.

14. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

15. Electronic Communications

When you visit the Site or send us emails or form submissions, you are communicating with us electronically. You consent to receive communications from us electronically, including responses related to your inquiries. Electronic communications satisfy any legal requirement that communications be in writing, to the extent permitted by law.

16. Governing Law and Venue

These Terms and any dispute arising out of or related to the Site or these Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. Subject to any mandatory law providing otherwise, you agree that exclusive jurisdiction and venue for such disputes lie in the state or federal courts located in Harris County, Texas, and you consent to personal jurisdiction there.

THE UNITED NATIONS CONVENTION ON CONTRACTS FOR THE INTERNATIONAL SALE OF GOODS DOES NOT APPLY TO THESE TERMS OR TO SITE USE.

17. Changes to These Terms

Hammonds may update these Terms at any time by posting a revised version on the Site and updating the “Last Updated” date. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms. If you do not agree, stop using the Site.

18. Severability; Waiver; Assignment

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable. Failure to enforce any provision is not a waiver. You may not assign these Terms without Hammonds’ prior written consent. Hammonds may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets.

19. Entire Agreement

These Terms, together with the Privacy Policy and any other policies or notices expressly incorporated by reference, constitute the entire agreement between you and Hammonds regarding use of the Site and supersede prior or contemporaneous understandings regarding Site use. They do not supersede signed commercial contracts for products or services.
